Death penalty sought in China Arnold case

Yesterday, a grand jury indicted (2006 CR 04928) China Arnold on one count of aggravated murder with aggravated special circumstances which allows for the death penalty. The Montgomery County Prosecutor's Office is actively pursuing the death penalty in this case.

Arnold's past history with the judicial system isn't one that will help her current situation. On 11 February 2000 (2000 CR 0302) she pled guilty to a charge of abduction, a third degree felony. She was sentenced to a fine "up to $10,000" and community control for up to five years. On 3 May 2002 (2002 CR 1154) she was indicted on verbal forgery. On 7 June 2002, after pleading guilty she was sentenced to a fine "up to $2500" and community control for one year. Her community control for both cases (2000 CR 0302 / 2002 CR 1154) was terminated on 29 June 2004.

On 1 December the court ordered that Children's Medical Center release the medical records & the chain of custody forms for Paris Talley for her treatment on 30 August 2005. Robert McCulloch, who was on the Nancy Grace program Thursday night via phone has suggested that the case won't appear before a jury for at least eighteen months.
